Purpose
These general terms of sale (GTS) govern the sales of digital products (AI-generated portraits) offered by PicDream, published by the company Empyreum.
Products and Services
PicDream offers an AI-powered portrait generation service. The customer uploads a photo and selects a theme. The service generates AI portraits from the provided photo. Results are unique digital creations. Available products are: digital portrait (HD download) and canvas portrait (printed on canvas, various sizes). Every canvas order automatically includes the corresponding HD digital portrait at no extra charge.
Prices
Prices are indicated in euros (€) including all taxes. PicDream reserves the right to change prices at any time. Products will be charged at the price in effect at the time of order validation.
Order and Payment
The order is validated after full payment. Payment is secured by our certified payment providers. An order confirmation is sent by email.
Delivery
Digital portraits are delivered via immediate download after generation. Generation time is typically under 60 seconds. Canvas portraits are shipped within 5 to 10 business days with tracking and insurance. Shipping costs are €9.99 per canvas ordered. The free HD digital portrait included with each canvas is available for immediate download, without waiting for canvas delivery.
Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for digital content provided on an intangible medium whose execution has begun with the consumer's consent. By validating the order, the customer agrees that portrait generation begins immediately and expressly waives their right of withdrawal. The free digital portrait included with a canvas purchase is a complimentary bonus tied to the order. In the event of a refund or cancellation of the canvas, the right to use the free digital portrait is automatically revoked.
Intellectual Property
The client retains all rights to the photos they upload. Generated portraits are the property of the client for personal and commercial use. PicDream reserves the right to use generated portraits (anonymized) for demonstration and service improvement purposes.
Liability
PicDream is committed to providing a quality service but does not guarantee a specific result. PicDream's liability is limited to the order amount in case of service defect.
Personal Data
Uploaded photos are processed solely for portrait generation and are deleted after processing. See our Privacy Policy for more details.
Applicable Law
These GTS are subject to French law. Any dispute shall be submitted to the competent courts.
